These General Terms and Conditions of Sale (hereinafter “CGV”) define the rights and obligations applicable in the context of the services offered by MONALISALOCS.
The CGV apply, without restriction or reservation, to two distinct types of services offered by MONALISALOCS:

MONALISALOCS reserves the right to refuse any request for a service that does not correspond to these profiles or to the criteria previously defined.
2.3. Changes
MONALISALOCS reserves the right to modify these Terms and Conditions at any time. The applicable version is the one in force on the date of validation of the service or signature of the contract. In the event of a change, the new conditions do not apply retroactively to commitments already entered into, unless there is a mandatory legal provision.
2.4. Regulatory framework — Preferential rate installation activity
The lock installation services provided by MONALISALOCS do not constitute a regulated hairdressing service within the meaning of the Public Health Code. They are offered to volunteers, at a reduced rate, in a framework clearly defined as:
No cutting, coloring, straightening, or chemical treatment is done. MONALISALOCS does not present itself as a hairdressing salon or as a qualified hairdressing organization. The participants are informed of this particular framework and expressly accept that the service is not a regulated hairdressing activity.
The services offered by MONALISALOCS are divided into two distinct categories. Each service is detailed in the information materials sent to the customer (file, contract, brochure or dedicated page).
MONALISALOCS offers structured support for women wishing to develop a professional activity around the Monalisalocs method. This support includes:
The precise conditions of this activity (duration of the commitment, rights and obligations, financial conditions, possible area of exclusivity) are detailed in the network contract signed separately and supplemented by these GTC.
MONALISALOCS also offers lock installation services within a framework strictly defined as follows:
The selected persons are informed in advance of the requirements of this service (punctuality, long-term commitment, etc.) and benefit from personalized post-installation follow-up.
As part of joining the MONALISALOCS network, the Partner has access to a structured set of services aimed at enabling it to launch, develop and structure a professional activity based on the MONALISALOCS method.

All of these elements are the subject of a detailed description in the partnership contract signed separately, which prevails over these GTC in the event of contradiction.
The performance of the services provided by MONALISALOCS within the framework of network activity follows a structured process, defined contractually. The entire process is based on a combination of training, access to digital resources, and individual or collective support.

MONALISALOCS reserves the right to change the content or modalities for educational or technical reasons, without calling into question the contractual commitment.
d) Technical support and after-sales service
Support requests can be sent by email or via the partner area. MONALISALOCS strives to respond within 7 working days. Assistance outside the contractual framework may be invoiced in addition.
Any request for assistance or complaints will be processed within 7 working days. This delay does not constitute a commitment to immediate resolution. Any absence of response within this period may not be interpreted as a failure by the Service Provider.
The lock installation services at a preferential rate offered by MONALISALOCS are exclusively part of a framework unregulated. They do not constitute nor a hairdressing service within the meaning of the Public Health Code, nor an activity related to a hairdressing salon or a qualified professional.
These services are carried out with the aim of technical improvement, of Putting the MONALISALOCS method into practice, and of creation of visual communication content. They do not give rise to no cutting, no chemical treatment, no permanent transformation of the hair.
MONALISALOCS does not carry out regulated hairdressing activities and does not claim the title of hairdresser in any way. Acceptance of this clause by the model constitutes recognition of the experimental, artistic and educational nature of the approach.

The service is provided all at once, in a place and at a date previously agreed with the model. The estimated duration is 8 to 12 hours, which may vary according to the density, texture and length of the hair.

MONALISALOCS reserves the right to refuse or discontinue the service if the hygiene conditions or the availability of the model are not respected, without this giving rise to reimbursement.
The service is considered to be entirely made and delivered once:
No subsequent changes or adjustments may be required, except in the case of obvious technical defect noted and reported within a maximum period of 48 hours after the performance of the service.
In case of discomfort, discomfort or question in the following days, the model can contact MONALISALOCS in writing (recommended email) within a period of 3 working days after the performance.

MONALISALOCS reserves the right to immediately interrupt the service or to terminate a contract in the event of abusive, disrespectful behavior or in clear contradiction with the values of the network.
MONALISALOCS declines all responsibility in the event of a dispute between several customers or co-participants who have booked a service or training together. The contractual contact person remains the person who made the reservation.
The customer is responsible for his personal effects throughout the duration of the service. MONALISALOCS cannot be held responsible in the event of loss, theft or degradation of personal items at the places of service.
The prices of the services offered by MONALISALOCS are expressed in euros (€), all taxes included (TTC), unless otherwise stated. They are communicated:

No appointments will be confirmed or maintained without a deposit.

Whatever the type of service, deposits paid are strictly non-refundable, except in case of formal cancellation by MONALISALOCS.
In case of cancellation by the customer, the model or the Partner, the deposit is automatically retained as a lump-sum compensation, intended to compensate for:
This principle applies even if the service has not yet started, from the moment the deposit has been paid.
In the event of abandonment or interruption of the training by the Partner, no partial refund may be required, the place having been reserved and the materials provided.
Payment facilities can be granted upon request, and at the sole discretion of MONALISALOCS. In case of agreement:
Any late payment automatically leads to:
Irrevocable commitment : Any order validated by the payment of a deposit constitutes a firm commitment. The customer cannot withdraw or request a refund, except in cases expressly provided for by law.
No automatic report : No extension of date will be accepted, unless expressly agreed in writing. Any withdrawal, absence or late request for a deferral will be treated as a cancellation at the initiative of the customer.
Free reassignment of the slot : In the event of cancellation or non-payment of the balance, MONALISALOCS reserves the right to freely reassign the slot to a third party, without obligation to replace or compensate.
Management fees : In case of breach of contract or cancellation of a service already undertaken, MONALISALOCS reserves the right to invoice fixed management fees of €100 including VAT, in addition to the non-reimbursement of the deposit.
No guarantee of subjective satisfaction : No refund request can be based on aesthetic dissatisfaction or on a discrepancy of unformalized expectations. The client acknowledges that the service responds to a specific technical framework, and not to a regulated hairdressing service.
In accordance with the provisions of articles L217-3 to L217-20 of the Consumer Code, MONALISALOCS guarantees the customer the conformity of the goods delivered (if applicable) with the order placed, under the conditions provided for by law.
In the event of a lack of conformity of a physical product delivered (tool, paper support, installation accessory, maintenance product, etc.), the customer benefits from a period of two (2) years from the date of delivery to assert their rights, in particular:
The customer is exempt from proving the existence of the lack of conformity in twenty-four (24) months following the delivery of the property.
This warranty only applies to material goods possibly provided under a contract (patented tool, maintenance shampoo, physical documentation, etc.). Elle is not applicable to the provision of services nor to digital content transmitted on a non-commercial basis (sheets, videos, online media, etc.).
MONALISALOCS services are subject to an obligation of means and are provided according to strict quality standards, with no commitment to commercial or aesthetic results.
No guarantee of result, subjective satisfaction or transformation can be claimed in this respect, unless proven and objectively observed failure to comply with contractual or technical commitments explicitly agreed upon.
The client or model expressly accepts this framework, in particular when the service is part of an educational, experimental or technical development framework.
a) Right of withdrawal (private customers — France only)
In accordance with articles L221-18 and following of the Consumer Code, the consumer customer has, when booking a remote service (email, telephone, online link), a period of fourteen (14) calendar days to exercise your right of withdrawal, without having to justify reasons or bear costs.

Any validation of an order or payment of a deposit is valid firm, definitive and irrevocable commitment. In case of withdrawal by the customer or model, the deposit is retained as full compensation, due to the loss of the slot, the logistical damage and the agreed price. No refund can be required except cancellation by MONALISALOCS.
In the event of the occurrence of an external, unforeseeable and irresistible event that makes the normal execution of commitments impossible (force majeure within the meaning of article 1218 of the Civil Code), the obligations of the parties will be suspended.
In particular, the following are considered to be cases of force majeure:
The prevented party must inform the other as soon as possible, justifying the event.
In the event of invocation of a case of force majeure, the party concerned must provide written proof. Otherwise, the cancellation will be considered as a classic cancellation with preservation of the deposit.
If the impediment exceeds 30 consecutive days, the contract may be automatically terminated without compensation, except reimbursement of services not performed (excluding deposit, except at fault of the Service Provider).
In accordance with article 1219 of the Civil Code, each party may suspend the performance of its obligations if the other party seriously breaches its obligations.

The model grants MONALISALOCS, free of charge, the right to use its image in this context, for a period of 10 years from the date of the service, and for exploitation on any territory (France + international), without limitation of support (web, print, advertising...).
The model may refuse this transfer of image rights in writing before the session, in this case MONALISALOCS reserves the right to select another model that meets the expected communication conditions.
The MONALISALOCS brand, its commercial name, its logos, its visuals and all associated elements are the subject of a official repository and are protected by the laws in force.
No use, reproduction or modification is authorized without the prior written consent of MONALISALOCS.
At the end of the service or support, MONALISALOCS can ask the customer, the model or the Partner in order to collect a opinion, testimony or feedback on the quality of collaboration.
Testimonial can be collected by:
MONALISALOCS undertakes never to publish a testimony without having obtained the prior agreement of the client concerned, explicitly, either in writing or in a traceable manner.
Customer testimonials, reviews, or feedback can be used for the purposes of:
They can be broadcast in anonymous or nominative form, with or without photo/video, according to the format transmitted and the explicit agreement of the customer. In case of nominative publication, the first name and/or the function may be mentioned.
The customer can, at any time, Request the withdrawal of his testimony, unless it is integrated into a non-public internal educational document.
MONALISALOCS reserves the right to slightly modify the style, spelling or structure of testimonies for the purpose of readability. The customer may request the withdrawal of his public notice at any time, excluding internal educational materials.
These General Terms and Conditions of Sale are governed by the French law, to the exclusion of any other legislation.
Any dispute relating to their interpretation, execution or validity will, in the absence of amicable resolution, fall under the exclusive jurisdiction of Courts of the jurisdiction of Fort-de-France, even in the event of multiple defendants or warranty claims.
In the event of a dispute relating to the execution or interpretation of these General Terms and Conditions of Sale, the parties undertake as a matter of priority to seek an amicable solution, by direct exchange and in good faith.
14.1. Consumer mediation (private customers — France only)
In accordance with articles L612-1 and following of the Consumer Code, any customer who is a consumer has the right to use a mediation system free of charge in order to resolve amicably a dispute between him and MONALISALOCS.
The customer can thus enter the competent mediator whose contact details will be communicated to him on request by email to: reseaumonalisalocs@gmail.com
In accordance with the regulations, MONALISALOCS may propose a mediator referred to the Commission for the Evaluation and Control of Consumer Mediation (CECMC).
Mediation is optional but can be initiated after an initial unsuccessful written procedure with the Service Provider.
If no amicable solution or mediation makes it possible to resolve the dispute, each party may refer the matter to the competent jurisdiction.
These terms and conditions are subject to French law, and any dispute will be brought before the Courts of the jurisdiction of Fort-de-France, unless otherwise required by mandatory jurisdiction.
In the interests of mutual respect, pedagogical coherence and the protection of the image of the MONALISALOCS brand, each customer, model or Partner undertakes to adopt professional, caring and respectful behavior throughout the collaboration.
