MONALISALOCS TERMS AND CONDITIONS

1. Professional contact details

These General Terms and Conditions of Sale apply to any order or reservation made from this date and are deemed to have been accepted without reservation by the customer.

Any reproduction or distribution of these GCS, in whole or in part, without written authorization from MONALISALOCS is strictly prohibited.

2. General provisions

These General Terms and Conditions of Sale (hereinafter “CGV”) define the rights and obligations applicable in the context of the services offered by MONALISALOCS.

2.1. Scope of application

The CGV apply, without restriction or reservation, to two distinct types of services offered by MONALISALOCS:

  • Network activity, including entrepreneurship support, training, the provision of tools, access to the MONALISALOCS brand, and integration into a structured development ecosystem;
  • The activity of installing locks at a preferential rate, carried out in a framework of perfecting techniques and creating visual content for the brand.

These CGV are made available to the customer prior to any validation of service:

  • via the official MONALISALOCS website,
  • or by direct transmission during the exchange of a quote, an appointment confirmation or a presentation file.

The validation of the reservation or the membership implies full and complete acceptance of these Terms and Conditions.

2.2. Type of clientele targeted

These services are aimed at:

  • To major individuals, for installations at a preferential rate,
  • To professionals or project leaders in the wellness or beauty sector, for network activity.

MONALISALOCS reserves the right to refuse any request for a service that does not correspond to these profiles or to the criteria previously defined.

2.3. Changes

MONALISALOCS reserves the right to modify these Terms and Conditions at any time. The applicable version is the one in force on the date of validation of the service or signature of the contract. In the event of a change, the new conditions do not apply retroactively to commitments already entered into, unless there is a mandatory legal provision.

2.4. Regulatory framework — Preferential rate installation activity

The lock installation services provided by MONALISALOCS do not constitute a regulated hairdressing service within the meaning of the Public Health Code. They are offered to volunteers, at a reduced rate, in a framework clearly defined as:

  • one space for technical experimentation,
  • one time for improvement and advanced practice,
  • And a moment of creation of visuals and content intended for communication.

No cutting, coloring, straightening, or chemical treatment is done. MONALISALOCS does not present itself as a hairdressing salon or as a qualified hairdressing organization. The participants are informed of this particular framework and expressly accept that the service is not a regulated hairdressing activity.

3. Description of the various services

The services offered by MONALISALOCS are divided into two distinct categories. Each service is detailed in the information materials sent to the customer (file, contract, brochure or dedicated page).

3.1. MONALISALOCS network activity

MONALISALOCS offers structured support for women wishing to develop a professional activity around the Monalisalocs method. This support includes:

  • Integration into a recognized professional network, with access to the reputation of the MONALISALOCS brand,
  • Compulsory initial training, in person or online, covering installation protocols and brand quality standards,
  • The provision of communication materials, document templates and organization tools,
  • Regular individual and group support, through follow-up sessions, personalized advice and internal events,
  • Access to privileged conditions for the purchase of hair supplies with brand partners,
  • The possibility of appearing on official communication media (website, social networks, etc.) within the limit of available places.

The precise conditions of this activity (duration of the commitment, rights and obligations, financial conditions, possible area of exclusivity) are detailed in the network contract signed separately and supplemented by these GTC.

3.2. Activity to install locks at a preferential rate

MONALISALOCS also offers lock installation services within a framework strictly defined as follows:

  • Public concerned : adults selected according to specific criteria (length, hair texture, etc.),
  • Objective : technical development of the practitioner, creation of visual communication content, demonstration of results,
  • Average duration of the service : 8 to 12 hours depending on the nature of the hair,
  • Financial conditions : preferential rate clearly indicated at the time of booking, with a mandatory non-refundable deposit to validate the date,
  • Specific conditions :

    • No cutting, coloring or chemical treatment performed

The selected persons are informed in advance of the requirements of this service (punctuality, long-term commitment, etc.) and benefit from personalized post-installation follow-up.

4. Methods of performance of services and delivery

4.1. Services related to MONALISALOCS network activity

4.1.1. Content of the services — Network activity

As part of joining the MONALISALOCS network, the Partner has access to a structured set of services aimed at enabling it to launch, develop and structure a professional activity based on the MONALISALOCS method.

Benefits include:

  • Access to the MONALISALOCS brand : the Partner is authorized to exploit the brand, trade name, communication universe and distinctive elements of the MONALISALOCS brand under the conditions provided for in the contract.
  • Mandatory initial training : this focuses on the techniques for installing and maintaining fine locks according to the MONALISALOCS method, the expected quality standards, as well as the relational and organizational approach specific to the brand. This training includes theoretical modules, demonstrations, practical exercises, as well as support in getting started with operational tools.
  • A set of professional resources : guides, standard documents, communication models, visual materials, visual materials, educational videos, access to secure tutorials, etc. These resources allow the Partner to carry out its activity while respecting the image of the brand and the best practices of the network.
  • Regular strategic and technical support : MONALISALOCS organizes collective and, where appropriate, individual follow-up sessions, in order to help the Partner structure its customers, respond to its technical problems, adjust its commercial practices and grow its business in accordance with the concept.
  • Access to official visibility channels : Partners can benefit from being highlighted on MONALISALOCS digital media (website, social networks, email campaigns, etc.) according to the conditions specified in the contract and within the limit of available places.
  • A referenced purchasing center : to guarantee the uniformity of services and the quality of the installations, MONALISALOCS provides access to products, tools or consumables specific to the network, under negotiated conditions.
  • Exclusive tools : the installation of fine locks is based on the use of exclusive techniques, a specific protocol and a patented or protected tool belonging to the grantor. The use of these tools is strictly reserved for members of the network and is governed by the partnership contract.

All of these elements are the subject of a detailed description in the partnership contract signed separately, which prevails over these GTC in the event of contradiction.

4.1.2. Terms of execution/delivery — Network activity

The performance of the services provided by MONALISALOCS within the framework of network activity follows a structured process, defined contractually. The entire process is based on a combination of training, access to digital resources, and individual or collective support.

a) Start of collaboration
The collaboration with the Partner takes effect after:

  • Signature of the partnership or distribution contract,
  • Reception of amounts due for entrance fees or initial training,
  • Final validation of the training schedule.

No service will be committed without meeting these conditions.

b) Delivery of services

  • Initial training : delivered in person or remotely, according to a pre-established schedule. The content includes practical, theoretical, and demonstration modules.
  • Digital resources : transmitted via a secure platform or electronically. Access is nominative and limited in time.
  • Accompaniments : planned in a calendar communicated in advance. Unjustified absences result in the loss of the corresponding session.
  • Exclusive tools : delivered under the conditions provided for in the contract, their use is strictly regulated.

c) Changes or adjustments
MONALISALOCS reserves the right to change the content or modalities for educational or technical reasons, without calling into question the contractual commitment.

d) Technical support and after-sales service
Support requests can be sent by email or via the partner area. MONALISALOCS strives to respond within 7 working days. Assistance outside the contractual framework may be invoiced in addition.

Any request for assistance or complaints will be processed within 7 working days. This delay does not constitute a commitment to immediate resolution. Any absence of response within this period may not be interpreted as a failure by the Service Provider.

4.2. Locks installation services at preferential rates

The lock installation services at a preferential rate offered by MONALISALOCS are exclusively part of a framework unregulated. They do not constitute nor a hairdressing service within the meaning of the Public Health Code, nor an activity related to a hairdressing salon or a qualified professional.

These services are carried out with the aim of technical improvement, of Putting the MONALISALOCS method into practice, and of creation of visual communication content. They do not give rise to no cutting, no chemical treatment, no permanent transformation of the hair.

MONALISALOCS does not carry out regulated hairdressing activities and does not claim the title of hairdresser in any way. Acceptance of this clause by the model constitutes recognition of the experimental, artistic and educational nature of the approach.

4.2.1. Content of the service

The service includes:

  • One prior exchange allowing to collect the expectations of the model and to analyze the feasibility of an installation according to the criteria of the MONALISALOCS method;
  • THEmanual installation of fine locks, according to a protocol specific to the MONALISALOCS brand, without cutting or chemical or mechanical intervention;
  • Of shots (photos and/or videos) carried out before, during and after the session, in accordance with the client's image rights;
  • One Final debrief, with oral and/or written transmission of home care recommendations.

No other services are included in the service, including:

  • No haircuts, even symbolic or cosmetic,
  • No application of coloring, shampoo, care or cosmetic product,
  • No hair product sales associated with the session,
  • No subsequent maintenance service provided in this context.

4.2.2. Execution procedures

The service is provided all at once, in a place and at a date previously agreed with the model. The estimated duration is 8 to 12 hours, which may vary according to the density, texture and length of the hair.

The model is committed to:

  • Show up with hair clean, dry, not artificially disentangled, and without any product or residue (oils, creams, gels, etc.);
  • To be available for the duration of the installation, without interruption;
  • Respect the instructions sent by MONALISALOCS before the session.

MONALISALOCS reserves the right to refuse or discontinue the service if the hygiene conditions or the availability of the model are not respected, without this giving rise to reimbursement.

4.2.3. Final delivery

The service is considered to be entirely made and delivered once:

  • the technical installation of the locks completed,
  • the shots taken,
  • and recommendations transmitted orally or in writing.

No subsequent changes or adjustments may be required, except in the case of obvious technical defect noted and reported within a maximum period of 48 hours after the performance of the service.

4.2.4. Complaints and returns

In case of discomfort, discomfort or question in the following days, the model can contact MONALISALOCS in writing (recommended email) within a period of 3 working days after the performance.

MONALISALOCS may, at its sole discretion:

  • propose a minor adjustment free of charge
  • or issue appropriate maintenance recommendations.

These adjustments do not constitute neither a right nor a contractual obligation, but are part of a benevolent approach specific to the ethics of the brand.

5. Obligations and responsibilities of the Service Provider

MONALISALOCS is committed to performing its services with professionalism, diligence and in compliance with its contractual commitments. However, its obligations vary according to the nature of the service provided.

5.1. General obligations

MONALISALOCS is committed to:

  • Provide services in accordance with the descriptions provided in the contractual documents,
  • To provide the human, technical and educational resources necessary to the realization of its commitments,
  • Ensuring the confidentiality of information exchanged within the framework of the contractual relationship,
  • Act in compliance with current regulations, within the limits of its declared area of competence.

5.2. Responsibility in the context of network activity

As part of the MONALISALOCS partnership:

  • MONALISALOCS is bound by an obligation of means: it makes every effort to support the Partner, without guaranteeing a financial or commercial result.
  • The provision of tools, resources and advice cannot replace the Partner's personal responsibility in the management and success of its business.
  • MONALISALOCS cannot be held responsible for a commercial failure or a delay in development linked to external factors, independent of its will (geographical area, personal strategy, partner failures, etc.).

5.3. Responsibility in the context of lock installations at preferential rates

As part of preferential rate installations:

  • MONALISALOCS is committed to performing the service according to the quality standards defined by the MONALISALOCS method, with no guarantee of subjective aesthetic results.
  • Since the intervention is carried out in a framework of technical improvement and communication, MONALISALOCS cannot be held responsible for an unmet expectation based on a personal assessment.
  • MONALISALOCS does not perform any cutting, chemical treatment, or irreversible transformation of the hair. Its responsibility is strictly limited to the installation method as described at the time of the service.
  • The model expressly recognizes that the service is not a regulated hairdressing activity and accepts to be styled in a technical, educational and experimental framework.
  • 5.4. Limits of liability

MONALISALOCS cannot be held responsible for:

  • the consequences of non-compliance by the customer or the Partner with the instructions sent,
  • indirect damage (loss of opportunity, moral damage, loss of income...),
  • the non-execution or poor execution of the contract attributable to the customer, to a third party, or to a case of force majeure.

In any event, MONALISALOCS's total liability, if incurred, would be capped at the amount actually received for the service concerned.

6. Obligations and responsibilities of the Customer

The Customer, Partner or Model undertakes to adopt a loyal, active and cooperative attitude throughout the duration of the contractual relationship.

6.1. General obligations of the Customer

The Customer or Partner undertakes to:

  • Provide accurate, complete and up-to-date information at the time of reservation, registration or contracting,
  • Pay the agreed amount on the scheduled dates, in accordance with the payment terms mentioned,
  • Respect organizational instructions, schedules and attendance commitments,
  • Not to disclose, use or reproduce without authorization confidential or protected elements belonging to MONALISALOCS,
  • Inform the Service Provider without delay of any impediment or difficulty that may compromise the normal performance of the service.

In the case of lock installation services, the model recognizes:

  • have been informed of the framework unregulated of the service,
  • act with full knowledge of the facts,
  • and respect the required hygiene and availability instructions.

6.2. Customer Responsibility

The Customer is responsible for:

  • the consequences of its own faults or breaches of contractual commitments,
  • damage, loss or inappropriate use of equipment made available,
  • any unauthorized distribution of protected content (documents, videos, visuals, etc.),
  • denigrating or defamatory public comments that damage the image or reputation of the Service Provider.

MONALISALOCS reserves the right to immediately interrupt the service or to terminate a contract in the event of abusive, disrespectful behavior or in clear contradiction with the values of the network.

MONALISALOCS declines all responsibility in the event of a dispute between several customers or co-participants who have booked a service or training together. The contractual contact person remains the person who made the reservation.

The customer is responsible for his personal effects throughout the duration of the service. MONALISALOCS cannot be held responsible in the event of loss, theft or degradation of personal items at the places of service.

7. Prices, terms of payment, late payment

7.1. Applicable prices and schedules

The prices of the services offered by MONALISALOCS are expressed in euros (€), all taxes included (TTC), unless otherwise stated. They are communicated:

  • either at a fixed rate (e.g. installation, training, network pack),
  • or on the basis of a schedule or quotation sent to the customer or partner.

Applicable prices are those in force at the time of validation of the order or the signing of the contract. MONALISALOCS reserves the right to change its prices at any time for any service not yet booked.

7.2. Payment terms

a) MONALISALOCS network activity

The Partner undertakes to:

  • Adjust a mandatory 50% deposit of the total amount at the time of signing,
  • Adjust the Balance no later than 48 hours before the start of the initial training or access to the digital workplace.

No access to training, tools or support will be granted without full payment.

b) Installation of locks at a preferential rate

The model is committed to:

  • Adjust a mandatory 50% deposit at the time of booking,
  • Adjust the balance remaining no later than the day of the service, before its start.

No appointments will be confirmed or maintained without a deposit.

Payments can be made:

  • by bank transfer,
  • by bank card via a secure link,
  • or by any other means offered to the customer.

7.3. Non-refundable nature of deposits

Whatever the type of service, deposits paid are strictly non-refundable, except in case of formal cancellation by MONALISALOCS.

In case of cancellation by the customer, the model or the Partner, the deposit is automatically retained as a lump-sum compensation, intended to compensate for:

  • the damage suffered by MONALISALOCS (window blocked, resources mobilized, time reserved),
  • preparatory or administrative expenses incurred,
  • and the loss of business opportunity.

This principle applies even if the service has not yet started, from the moment the deposit has been paid.

In the event of abandonment or interruption of the training by the Partner, no partial refund may be required, the place having been reserved and the materials provided.

7.4. Payment in several installments

Payment facilities can be granted upon request, and at the sole discretion of MONALISALOCS. In case of agreement:

  • a schedule will be established in writing,
  • Any delay in a due date will result in the immediate payment of the outstanding balance, without prior notice.

7.5. Late or non-payment

Any late payment automatically leads to:

  • The suspension of access to the service concerned (training, appointments, support, etc.),
  • the immediate exigibility of all amounts due,
  • The application of late payment penalties, at the legal rate in force, increased by 10 points,
  • and, for professional customers, a lump-sum recovery fee of €40, in accordance with articles L441-10 and D441-5 of the Commercial Code.

7.6. Reinforced Provider Protection Clauses

Irrevocable commitment : Any order validated by the payment of a deposit constitutes a firm commitment. The customer cannot withdraw or request a refund, except in cases expressly provided for by law.

No automatic report : No extension of date will be accepted, unless expressly agreed in writing. Any withdrawal, absence or late request for a deferral will be treated as a cancellation at the initiative of the customer.

Free reassignment of the slot : In the event of cancellation or non-payment of the balance, MONALISALOCS reserves the right to freely reassign the slot to a third party, without obligation to replace or compensate.

Management fees : In case of breach of contract or cancellation of a service already undertaken, MONALISALOCS reserves the right to invoice fixed management fees of €100 including VAT, in addition to the non-reimbursement of the deposit.

No guarantee of subjective satisfaction : No refund request can be based on aesthetic dissatisfaction or on a discrepancy of unformalized expectations. The client acknowledges that the service responds to a specific technical framework, and not to a regulated hairdressing service.

8. Legal and commercial guarantees

8.1. Legal guarantees applicable to goods

In accordance with the provisions of articles L217-3 to L217-20 of the Consumer Code, MONALISALOCS guarantees the customer the conformity of the goods delivered (if applicable) with the order placed, under the conditions provided for by law.

In the event of a lack of conformity of a physical product delivered (tool, paper support, installation accessory, maintenance product, etc.), the customer benefits from a period of two (2) years from the date of delivery to assert their rights, in particular:

  • the repair or replacement of the goods within a reasonable period of time and at no additional cost,
  • or, failing that, the reduction of the price or the reimbursement of the product.

The customer is exempt from proving the existence of the lack of conformity in twenty-four (24) months following the delivery of the property.

This warranty only applies to material goods possibly provided under a contract (patented tool, maintenance shampoo, physical documentation, etc.). Elle is not applicable to the provision of services nor to digital content transmitted on a non-commercial basis (sheets, videos, online media, etc.).

8.2. Guarantees related to the provision of services

MONALISALOCS services are subject to an obligation of means and are provided according to strict quality standards, with no commitment to commercial or aesthetic results.

No guarantee of result, subjective satisfaction or transformation can be claimed in this respect, unless proven and objectively observed failure to comply with contractual or technical commitments explicitly agreed upon.

The client or model expressly accepts this framework, in particular when the service is part of an educational, experimental or technical development framework.

9. Assumptions for the end of the collaboration

a) Right of withdrawal (private customers — France only)

In accordance with articles L221-18 and following of the Consumer Code, the consumer customer has, when booking a remote service (email, telephone, online link), a period of fourteen (14) calendar days to exercise your right of withdrawal, without having to justify reasons or bear costs.

This deadline is short:

  • As of date of conclusion of the contract (or validation of the order) for the provision of a service,
  • or as of Reception of the property for an order for a physical product.

Any request for withdrawal must be sent exclusively at the following address: reseaumonalisalocs@gmail.com.
Any complaint or notification sent to another address will not be taken into account.
It is the customer's responsibility to ensure that his request has been sent to this address and to keep a proof of dispatch.

b) Waiver of the right of withdrawal — planned services

The customer expressly acknowledges that the services offered by MONALISALOCS are:

  • scheduled for a specific date agreed upon at the time of booking,
  • mobilize a strong logistical organization, with preparation, equipment, travel, and mobilization of a single niche,
  • are part of a specific pedagogical or experimental framework, in a limited number of participants,
  • and benefit from a preferential rate granted in return for this firm commitment.

In accordance with article L221-28 of the Consumer Code, the customer:

  • expressly requests that the service be performed on this specific date,
  • and renounces his right of withdrawal for this order, even if it was placed remotely.

Any validation of an order or payment of a deposit is valid firm, definitive and irrevocable commitment. In case of withdrawal by the customer or model, the deposit is retained as full compensation, due to the loss of the slot, the logistical damage and the agreed price. No refund can be required except cancellation by MONALISALOCS.

9.2. Force majeure

In the event of the occurrence of an external, unforeseeable and irresistible event that makes the normal execution of commitments impossible (force majeure within the meaning of article 1218 of the Civil Code), the obligations of the parties will be suspended.

In particular, the following are considered to be cases of force majeure:

  • natural disaster, pandemic, general strike, fire, flood,
  • serious illness, hospitalization, or death of the worker

The prevented party must inform the other as soon as possible, justifying the event.

In the event of invocation of a case of force majeure, the party concerned must provide written proof. Otherwise, the cancellation will be considered as a classic cancellation with preservation of the deposit.

If the impediment exceeds 30 consecutive days, the contract may be automatically terminated without compensation, except reimbursement of services not performed (excluding deposit, except at fault of the Service Provider).

9.3. Exemption of non-performance

In accordance with article 1219 of the Civil Code, each party may suspend the performance of its obligations if the other party seriously breaches its obligations.

As such:

  • MONALISALOCS may suspend a service or terminate a contract in the event of non-payment, non-compliance with instructions, unjustified absence, repeated delays, or behavior contrary to ethics and brand values.
  • The customer may suspend or refuse to perform its obligations if MONALISALOCS breaches its essential commitments, after a formal notice that has remained ineffective.

Any suspension or termination on this basis must be notified In writing, in a motivated way.

10. Collection and processing of personal data

MONALISALOCS, represented by its President Ms. Clarisse SAINT-PRIX, acts as person responsible for the processing of personal data collected as part of its commercial, educational and contractual activities.

10.1. Data collected

As part of the reservation, contracting or access to its services, MONALISALOCS is required to collect the following data:

  • Name, first name, email address, telephone, postal address (if necessary),
  • Information related to professional activity (as part of the network),
  • Information on the nature of the hair (as part of installation services),
  • Booking history, written exchanges, and billing information.

This data is collected via:

  • contact or registration forms,
  • discovery calls or preliminary interviews,
  • application forms for benefits.

10.2. Purposes of the treatment

The personal data collected is used exclusively for:

  • the management of reservations, payments and contracts,
  • the execution of the services requested,
  • communication before, during and after the service,
  • sending information, reminders or educational content as part of the network,
  • the management of potential disputes,
  • compliance with legal and accounting obligations.

No data is transferred, rented or sold to a third party for commercial purposes.

10.3. Shelf life

The data is stored:

  • throughout the duration of the contractual relationship,
  • then archived during 5 years for administrative, fiscal and legal purposes,
  • unless otherwise required or expressly requested for early deletion (in cases authorized by law).

10.4. Rights of the person concerned

In accordance with the General Data Protection Regulation (RGPD), anyone whose data has been collected has the following rights:

  • right of access to your data,
  • right to correction,
  • right to erasure (“right to be forgotten”),
  • right to the limitation of treatment,
  • right to object,
  • right to data portability,
  • right to file a complaint with the CNIL.

10.5. Security and confidentiality

MONALISALOCS is committed to implementing all the technical and organizational measures necessary to protect personal data against loss, destruction, unauthorized access or fraudulent use.

The data is hosted on secure digital tools (Google Drive, billing or reservation tools) and is accessible only by authorized persons within MONALISALOCS.

11. Intellectual property clause

11.1. Creations and contents produced by MONALISALOCS

All educational materials, documents, visuals, videos, videos, digital content, digital content, technical tools or concepts transmitted as part of the services provided by MONALISALOCS are original creations protected by intellectual property law (Intellectual Property Code, articles L111-1 and following).

They remain the exclusive property of MONALISALOCS or their respective authors, unless otherwise stated in writing.

This includes in particular:

  • installation or maintenance protocols,
  • practical sheets, training or explanation videos,
  • the supports transmitted in PDF or by private link,
  • demonstration photos, brand visuals, logos, descriptive texts,
  • personalized documents used as part of the support.

11.2. Use by the customer or the Partner

The customer, the model or the Partner only benefits from:

  • Of a right of personal, non-exclusive and non-transferable use of these contents,
  • Within the limit strictly necessary for the performance of the service or for personal learning.

He is strictly forbidden to the customer:

  • to reproduce, copy, share, publish or broadcast all or part of these contents, without written authorization,
  • to modify, adapt or market them,
  • to use them for competitive purposes or outside the contractual framework provided for.

In the event of a violation, MONALISALOCS reserves the right to sue and claim damages.

11.3. Transfer of image rights (models only)

In the context of lock installations carried out at a preferential rate, the model accepts that photos and/or videos are taken before, during and after the service, for the purposes of:

  • educational (training, demonstration),
  • commercial (communication, social networks, website, printed visuals).

The model grants MONALISALOCS, free of charge, the right to use its image in this context, for a period of 10 years from the date of the service, and for exploitation on any territory (France + international), without limitation of support (web, print, advertising...).

The model may refuse this transfer of image rights in writing before the session, in this case MONALISALOCS reserves the right to select another model that meets the expected communication conditions.

11.4. Ownership of the MONALISALOCS brand

The MONALISALOCS brand, its commercial name, its logos, its visuals and all associated elements are the subject of a official repository and are protected by the laws in force.

No use, reproduction or modification is authorized without the prior written consent of MONALISALOCS.

12. Reviews and testimonies

At the end of the service or support, MONALISALOCS can ask the customer, the model or the Partner in order to collect a opinion, testimony or feedback on the quality of collaboration.

12.1. Collection methods

Testimonial can be collected by:

  • written form,
  • audio or video recording,
  • free written message (email, voice message, private message on social networks),
  • online or face-to-face interview with the agreement of the interested party.

MONALISALOCS undertakes never to publish a testimony without having obtained the prior agreement of the client concerned, explicitly, either in writing or in a traceable manner.

12.2. Use of testimonies

Customer testimonials, reviews, or feedback can be used for the purposes of:

  • pedagogical (feedback from experience in training courses),
  • commercial (reinsurance, visibility),
  • promotional (social networks, website, newsletter...).

They can be broadcast in anonymous or nominative form, with or without photo/video, according to the format transmitted and the explicit agreement of the customer. In case of nominative publication, the first name and/or the function may be mentioned.

The customer can, at any time, Request the withdrawal of his testimony, unless it is integrated into a non-public internal educational document.

MONALISALOCS reserves the right to slightly modify the style, spelling or structure of testimonies for the purpose of readability. The customer may request the withdrawal of his public notice at any time, excluding internal educational materials.

13. Applicable law

These General Terms and Conditions of Sale are governed by the French law, to the exclusion of any other legislation.

Any dispute relating to their interpretation, execution or validity will, in the absence of amicable resolution, fall under the exclusive jurisdiction of Courts of the jurisdiction of Fort-de-France, even in the event of multiple defendants or warranty claims.

14. Mediation and dispute resolution

In the event of a dispute relating to the execution or interpretation of these General Terms and Conditions of Sale, the parties undertake as a matter of priority to seek an amicable solution, by direct exchange and in good faith.

14.1. Consumer mediation (private customers — France only)

In accordance with articles L612-1 and following of the Consumer Code, any customer who is a consumer has the right to use a mediation system free of charge in order to resolve amicably a dispute between him and MONALISALOCS.

The customer can thus enter the competent mediator whose contact details will be communicated to him on request by email to: reseaumonalisalocs@gmail.com

In accordance with the regulations, MONALISALOCS may propose a mediator referred to the Commission for the Evaluation and Control of Consumer Mediation (CECMC).

Mediation is optional but can be initiated after an initial unsuccessful written procedure with the Service Provider.

14.2. Court settlement in case of failure

If no amicable solution or mediation makes it possible to resolve the dispute, each party may refer the matter to the competent jurisdiction.

These terms and conditions are subject to French law, and any dispute will be brought before the Courts of the jurisdiction of Fort-de-France, unless otherwise required by mandatory jurisdiction.

15. Non-denigration clause and expected customer behavior

In the interests of mutual respect, pedagogical coherence and the protection of the image of the MONALISALOCS brand, each customer, model or Partner undertakes to adopt professional, caring and respectful behavior throughout the collaboration.

Non-denigrating

  • The customer undertakes to:
  • not to hold, publish, broadcast or relay remarks or content that is denigrating, defamatory or likely to harm the image, reputation or interests of MONALISALOCS, its representatives or other members of the network,
  • whether in public or in private, on any medium, including (but not limited to): social networks, forums, review sites, messaging platforms or private groups.
  • This obligation lasts for the duration of the contract and until 12 months after its end, regardless of the cause.
  • Any breach of this clause may lead to civil and/or criminal proceedings, and to a request for full compensation for the damage suffered.

Expected behavior

  • The customer, model or partner also undertakes to:
  • demonstrate punctuality, clarity in communication, and respect for commitments made,
  • not to interfere with the smooth running of collective or individual services,
  • respect the people, equipment, places, deadlines and internal rules of the MONALISALOCS network.
  • MONALISALOCS reserves the right to immediately interrupt any service or to refuse access to its services in the event of behavior deemed incompatible with the values of the brand.
  • Any public use of the name MONALISALOCS engages the responsibility of its author. MONALISALOCS reserves the right to request the immediate withdrawal of any content that is defamatory, false or that damages the brand's image.

These General Terms and Conditions of Sale apply to any order or reservation made from this date and are deemed to have been accepted without reservation by the customer.
